Domain Registration Terms

These Domain Registration Specific Terms (“Domain Terms”), along with our Terms of Use (“TOU”), and any other terms and policies referenced in the TOU or these Domain Terms, apply to your access to and/or use of the domain registration services (part of the Services as defined in the TOU) as described in more detail below. These Domain Terms are incorporated by reference into our TOU. Any capitalized terms (or lowercase terms specifically defined in TOU, not defined in these Domain Terms) have the meanings set forth in the TOU. Except as expressly noted in Domain Terms, the terms of the TOU govern in case of conflict or inconsistency.

1. Definitions

1.1 ICANN. ICANN means the Internet Corporation for Assigned Names and Numbers.

1.2 Reseller. A Reseller provides domain name registration services to registrants through third-party Registrars pursuant to an agreement with Registrar or with Registrar's actual knowledge, including collecting registration data about registrants, submitting that data to Registrar, and/or or facilitating the entry of the registration agreement between the Registrar and the registrant.

1.3 Registrar. A Registrar offers domain name registration services in generic top-level domains (gTLDs) and/or country code top-level domains (ccTLDs) to registrants.

2. Domains Registration Services

Reseller Services. We act as a Reseller of domain name registration services to registrants through the third-party Registrar, Name.com, Inc. You understand and agree that we are not acting as the Registrar when you use our domain name registrations services and that Name.com, Inc. is a Third Party Service (as defined in Section 9 of our TOU).

As a result, when you make a domain name purchase, renewal, or transfer, you also agree, and are subject to, Name.com's Domain Name Registration Agreement and, if applicable to your purchase, the Whois Privacy Service Agreement (together the “Third Party Registrar Terms). You further understand and agree that you will not violate Name.com's Acceptable Use Policy. Your breach of the applicable Third Party Registrar Terms is a breach of our TOU.

3. ICANN Rules, Policies, and Benefits

By using our domain name registration services, you are also subject, and agree, to the ICANN’s policies, including without limitation the ICANN dispute resolution and other policies. As a registrant, you understand and agree that you have the rights and responsibilities set forth in ICANN’s Registrants’ Benefits and Responsibilities as applicable.

4. Transfers, Refunds, Renewals

4.1 External Transfers. You may not transfer your domain name registration to another domain name registrar for sixty (60) days following: (i) the effective date of your purchase through our Services or (ii) a change in the Change of Registrant (as such term is defined in the ICANN Transfer Policy) unless you expressly opted out of such lockout at the time of the change.

4.2 Expirations and Renewals. Unless you’ve otherwise disabled auto-renewals, we will attempt to notify you via the billing contact information you provided us in connection with your subscription 30 days prior to your auto-renewal. If you have disabled auto-renewals, the third-party Registrar will attempt to notify you via your domain name registration contact information (or WHOIS contact information) of your non-renewal 30 days before, 5 days before, and within 5 days after your scheduled domain name expiration date.

You agree to ensure that your billing contact information and WHOIS information are accurate, current, and complete. We or the third party Registrar, as applicable, use the contact information to send you important information about your domain name registration via the Services.

Notwithstanding the foregoing, it is your responsibility to renew your domain name registration.

4.3 Refunds. We do not offer refunds on domain name registration purchases or transfers. However, if you cancel your domain name purchase within (5) days, our third party Registrar may provide a full to the extent permitted by the Third Party Registrar Terms.

5. Privacy

We or our third party Registrar have the right to disclose your domain registration contact, WHOIS or other protocol system information as part of your registration of your domain name and use of our Services in order to comply with ICANN’s or registry’s rules and policies for the applicable domain name. Our Privacy Notice further describes how we process your information.

6. Term and Termination

These Domain Terms remain in effect until the terms our TOU is terminated as set forth in Section 12 of the TOU. The sections of these Domain Terms that by their nature should survive termination shall survive termination.

7. General

7.1 Conflicts. To the extent that there is a conflict between these Domain Terms and Name.com's Domain Name Registration Agreement, the terms of the Name.com's Domain Name Registration Agreement will control solely to the extent of the conflict.

7.2 Modifications to these Terms. We reserve the right to modify these Domain Terms from time to time. We will post the most current version on this page with the most recent effective date at the top. If a modification meaningfully changes your rights or obligations, will notify you as set forth in Section 15 of our TOU. Your continued use of our Services after the effective date of such changes constitutes your acceptance of such changes to the modified Domain Terms and pricing changes. If you disagree with any modifications to the Domain Terms, then you must stop using the applicable Services and cancel the applicable paid services (as defined in Section 6 of our TOU).
